LMIA-Eligible Job Occupation Checker
Select your occupation and situation. See whether your Canadian job offer needs an LMIA, qualifies for an exempt stream, and what work permit pathway applies to you.
What Nigerian Job Seekers Get Wrong About LMIA
- β Thinking an LMIA is a visa. An LMIA is a document the Canadian employer applies for, not you. It confirms no Canadian citizen or PR was available for the job.
- β Asking an employer to get an LMIA without understanding the employer’s cost: CAD 1,000 application fee plus significant administrative time. Many small employers refuse.
- β Not knowing that a valid LMIA-based job offer adds 50 or 200 CRS points in Express Entry. Nigerian applicants with LMIAs significantly improve their PR odds.
- β Ignoring LMIA-exempt pathways. Many skilled roles qualify for the International Mobility Program (IMP), which does not require an LMIA and is faster.
- β Paying an agent for an “LMIA job offer”. Legitimate LMIA offers come directly from employers who advertise the role publicly. Any agent charging a fee to connect you with an LMIA employer is almost certainly a scam.
How the LMIA Check Works
Most Canadian work permits for foreign nationals fall into one of two categories: LMIA-required (employer must prove no Canadian was available for the job) or LMIA-exempt (employer does not need this proof because the hire benefits Canada in a way that justifies an exemption). The tool maps your occupation, situation, and employer type against the known exemption codes and LMIA requirements.
If LMIA-exempt: β IMP pathway (International Mobility Program)
Exemption code: C10 (significant benefit), C11 (intra-company),
R204 (CUSMA/trade agreements), or open work permit
If LMIA-required: β Temporary Foreign Worker Program (TFWP)
High-wage stream or Low-wage stream based on wage level
LMIA Explained: What Nigerian Applicants Need to Know
A Labour Market Impact Assessment (LMIA) is a document issued by Employment and Social Development Canada (ESDC) that authorises a Canadian employer to hire a foreign worker for a specific role. The employer applies for the LMIA, not the worker. The employer must demonstrate that they advertised the role to Canadians first and could not find a suitable Canadian or PR to fill the position.
An LMIA costs the employer CAD 1,000 per position applied for. Processing times range from 2 to 5 months for most occupations. The Global Talent Stream (GTS) is a fast-tracked LMIA process for certain tech roles that can process in 2 weeks.
LMIA-Exempt Pathways: Faster Routes for Skilled Nigerians
Many skilled Nigerian workers qualify for work permits that do not require an LMIA through the International Mobility Program (IMP). The most relevant exemptions are:
| Exemption Code | Who It Applies To | Processing Speed |
|---|---|---|
| C10 (Significant Benefit) | Roles that provide a significant cultural, economic, or social benefit to Canada. Difficult to use without a strong justification letter. | 4 to 8 weeks |
| C11 (Self-employed / Entrepreneur) | Self-employed persons or entrepreneurs with significant business impact in Canada. | 8 to 16 weeks |
| R204 / CUSMA | Roles covered under the Canada-United States-Mexico Agreement (formerly NAFTA). Not directly applicable to Nigerian nationals. | N/A for Nigerians |
| PGWP (Open Work Permit) | Graduates of Canadian institutions. No employer restriction; no LMIA needed. | 2 to 4 months after graduation |
| LMIA-Exempt via PNP | Workers nominated by a province. Provincial work permit letter allows work without LMIA. | Depends on PNP timeline |
| Open Work Permit (OWP) β Spouse | Spouses of skilled workers or students may qualify for an open work permit. | 2 to 4 months |
The Global Talent Stream: Why Nigerian Tech Workers Should Know It
The Global Talent Stream (GTS) is a fast-tracked LMIA process for employers hiring in specific high-demand technology and STEM occupations. Under GTS Category A, an employer does not need to prove labour market advertising if they are referred by a designated partner. Under Category B, employers hire for occupations on the Global Talent Occupations List (GTOL).
GTS processes LMIAs in approximately 2 weeks. For Nigerian software engineers, data scientists, and IT professionals with offers from Canadian tech companies, GTS is often the fastest work permit route. The employer must be designated or the occupation must be on the GTOL. Nigeria does not have a bilateral arrangement, so GTS is the LMIA, just a much faster one.
LMIA and the Express Entry CRS Score
A valid job offer supported by a positive LMIA adds significant CRS points:
- NOC TEER 0 (senior management) or NOC 00: +200 CRS points
- NOC TEER 1, 2, or 3 (most skilled roles): +50 CRS points
For a Nigerian applicant with CRS 450 who is 30 to 40 points below the general draw cutoff, a TEER 1 job offer with an LMIA adds 50 CRS points and brings the score to 500, potentially pushing them above the cutoff. This is one of the most direct ways to improve a CRS score that does not involve waiting or retaking a language test.
Table of Truth: Occupation vs Most Likely Work Permit Path
| Occupation | From Nigeria | On PGWP in Canada | CRS Impact (job offer) |
|---|---|---|---|
| Software Engineer | LMIA (GTS Category B, ~2 wks) or IMP C10 | Open work permit (PGWP); no LMIA needed | +50 CRS if LMIA obtained |
| Registered Nurse | LMIA (Healthcare stream, 2-5 months) | PGWP; no LMIA for existing employer | +50 CRS if LMIA obtained |
| Accountant | LMIA (standard TFWP, 3-5 months) | PGWP; no LMIA | +50 CRS if LMIA obtained |
| Electrician (Journeyman) | LMIA (Trades stream, 2-4 months) | PGWP or LMIA work permit | +50 CRS if LMIA obtained |
| Truck Driver | LMIA (required; low-wage stream) | PGWP or LMIA | +50 CRS if LMIA obtained |
| Farm Worker | LMIA (SAWP or seasonal stream) | PGWP if from eligible program | +50 CRS if LMIA obtained |
| IT Manager | LMIA (GTS Category A or B) or C10 | PGWP; employer can retain without LMIA | +200 CRS (TEER 0) or +50 CRS (TEER 1) |
Realistic Scenarios
Scenario 1: Nigerian Software Engineer in Lagos, Offer from Calgary Startup
Tunde has a job offer from a Calgary tech startup for a backend developer role (NOC 21211). The startup is small (12 employees) and has never hired internationally. The role is on Canada’s Global Talent Occupations List. The employer applies for a GTS Category B LMIA. Processing target: approximately 2 weeks. Once the LMIA is positive, Tunde applies for a LMIA-based work permit from Nigeria. Total time from offer to work permit in hand: approximately 3 to 5 months. The LMIA adds 50 CRS points to Tunde’s Express Entry profile, boosting his score from 455 to 505.
Scenario 2: Nigerian Registered Nurse on PGWP in Nova Scotia
Ngozi graduated from a Nova Scotia nursing program and is working as a registered nurse (NOC 31301) on a PGWP. Her employer wants to keep her and is asking whether they need an LMIA. Because Ngozi is on a PGWP, she is already authorized to work for any employer in Canada without an LMIA. The employer does not need to do anything. Ngozi keeps working and builds toward her 12 months of Canadian experience for CEC eligibility. When she applies for PR through CEC, a supporting job offer from her employer (even without an LMIA) adds credibility to her application narrative.
Scenario 3: Nigerian Petroleum Engineer, Intra-Company Transfer
Emeka works for an international oil and gas company in Lagos. His employer has a Canadian subsidiary in Calgary and wants to transfer him to the Calgary office for 2 years. Intra-company transfers for workers in managerial, executive, or specialized knowledge roles are LMIA-exempt under the International Mobility Program (exemption code C12). The employer applies for an employer-specific open work permit on Emeka’s behalf without an LMIA. Processing: approximately 4 to 8 weeks. This is a significantly faster and simpler pathway than a standard LMIA for companies that have operations in both Nigeria and Canada.
Common Questions
Can I apply for a Canadian work permit without a job offer?
For employer-specific work permits, a job offer is required. For open work permits (PGWP, spouse of skilled worker, certain humanitarian categories), no specific job offer is needed. Express Entry PR applications do not require a job offer either, though having one adds CRS points.
How long does an LMIA last?
A positive LMIA is typically valid for 6 months from the date it is issued. The employer must apply for the work permit during this period. If the work permit application is not submitted within the validity window, the LMIA expires and the employer must reapply.
Does the LMIA restrict which job I can do in Canada?
Yes. An LMIA-based work permit is employer-specific and role-specific. You can only work for the employer named in the LMIA, in the occupation specified, at the location specified. Changing employers or roles requires either a new LMIA or a different work permit pathway.
Can I find LMIA job offers online?
Legitimate LMIA-required jobs are typically posted on Canadian job boards like Indeed.ca, LinkedIn, Job Bank Canada, and Workopolis. The employer is required to have advertised the role to Canadians before applying for an LMIA. Any website claiming to sell access to LMIA job offers or charging you a fee to connect you with an LMIA employer is almost certainly fraudulent. Employers pay for LMIAs; workers do not.
Does the LMIA fee come out of my salary?
No. The LMIA application fee (CAD 1,000) is paid by the employer, not the worker. It is illegal for an employer to deduct this fee from the worker’s wages or to require the worker to reimburse it.
What is the difference between a high-wage and a low-wage LMIA stream?
LMIA applications are streamed based on whether the offered wage is at or above the provincial median hourly wage. High-wage stream positions typically face more scrutiny on advertising requirements. Low-wage stream positions have stricter caps on the proportion of temporary foreign workers an employer can have. Most skilled Nigerian applicants fall into the high-wage stream.
